TROPICAL ESCAPES DESTINATION WEDDINGS AND TRAVEL INC.
Terms and Conditions – Please read this as it constitutes part of your contract for travel arrangements services.
Tropical Escapes Destination Weddings and Travel Inc. and www.tropicalescapes.ca are herein referred to as “Tropical Escapes Destination Weddings and Travel Inc.”, “TEDWT”, “Agency”, “We”, “Us”, and “Our”.
Booking Passenger is herein referred to as “Booking Passenger”, “Passenger”, “Traveler”, and “You”.
Please thoroughly review these Terms and Conditions of Tropical Escapes Destination Weddings and Travel Inc. The Booking Passenger(s) of this notice will be the only recipient of the booking receipt, invoice and terms and conditions. It is the sole responsibility of the Booking Passenger(s) to inform all other Passengers traveling together or sharing the room of the contents of these Terms and Conditions. The Booking Passenger(s), by accepting this receipt and making payment to TEDWT, accepts all financial responsibility and acknowledges that they have been advised of, reviewed, and hereby accept these Terms and Conditions and contract for travel related services. You acknowledge and agree that we may change these Terms and Conditions from time to time and that those changes become effective immediately. You agree to be bound by the Terms and Conditions that are in effect at the time of your travel or cancellation, whichever applies. You agree that it is your responsibility to be familiar with these Terms and Conditions and to check back from time to time for any changes.
COVID-19 Release: The client expressly acknowledges that naturally occurring diseases and viruses (including, but not limited to, the currently widespread COVID-19) may be present and actively occurring in all environments in which your vacation will take place. You acknowledge the novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. You acknowledge that COVID-19 has made travel uncertain due to government closures and travel restrictions. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact (however the exact method of spread remains unknown). You also understand that if you are older or have underlying conditions, you may be more prone to serious infection and death due to COVID-19. As a result of the highly infectious nature of this disease, federal, state, and local governments and federal and state health agencies recommend social distancing, wearing of PPE (including masks), and have, in many locations, prohibited the congregation of groups of people. You acknowledge that exposure to such viruses or disease is an inherent risk of traveling, that cannot be controlled or eliminated by TEDWT.
By making a booking at this time, you acknowledge the highly contagious nature of COVID-19 and voluntarily assume the risk for yourself and any minors traveling with you, that you or they may be exposed to or infected by COVID-19 by traveling and that such exposure or infection may result in personal injury, illness, permanent disability, and death. You acknowledge that due to the uncertainty of travel at this time, your trip may be postponed or cancelled or changes may be made to itineraries due to closures of certain sites or activities, for which there may be no refund. You understand that you may become sick before the trip and may not be able to travel and such cancellation will be subject to suppliers cancellation terms. You also acknowledge that you may become sick during the trip and that your travel plans may change, for which we will not be liable.
You understand the description of the risks due to COVID-19 is not complete and that unknown or unanticipated risks may result in injury, illness, death or any other loss. You agree that having considered these risks, you, for yourself, and any minors traveling with you, desire to book travel at this time and that you freely and voluntarily assume complete personal responsibility for the risk of exposure, illness, death, delay, postponement, change, and cancellation due to COVID-19, for yourself and any minors traveling with you, even if such injuries or losses occur in a manner that is not foreseeable at the time the booking is made.
You agree that due to uncertainty caused by COVID 19, TEDWT has strongly encouraged the purchase of travel protection coverage including cancel for any reason coverage, and that should you fail to purchase travel protection coverage, TEDWT shall not be liable to any losses howsoever arising.
You, for yourself, and any minors traveling with you, and on behalf of my and their heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS TEDWT, its officers, agents, and/or employees, suppliers, and other participants (RELEASEES), from any and all claims, demands, losses, and liability arising out of or related to any POSTPONEMENT, CANCELLATION, CHANGES, INJURY, DISABILITY, DEATH OR ANY OTHER LOSS you may suffer due to exposure, infection, spread, closure, and travel restrictions related to COVID- 19, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
DISCLAIMER: Tropical Escapes Destination Weddings and Travel Inc. is acting as a mere agent for suppliers in selling travel-related services, or in accepting reservations or bookings for services that are not directly owned or operated by this travel agency (such as but not limited to air and ground transportation, hotel accommodations, meals, tours, cruises). TEDWT is an independent contractor and is not an employee, agent, or representative of any of these suppliers. All suppliers are independent contractors and are not agents or employees or representatives of TEDWT. All travel services arranged by TEDWT are subject to any and all applicable laws, regulations, tariffs, and the terms and conditions of any agreement with a supplier. TEDWT shall not be responsible for breach of contract or any intentional or careless actions or omissions on part of such suppliers, which result in any loss, damage, delay, or injury to the Passenger(s). TEDWT is not responsible for any default by our suppliers. TEDWT shall not be responsible for failure to perform any obligation of this contract due to unforeseen circumstances or causes beyond our reasonable control, including but not limited to acts of God (Force Majeure), war, riot, acts of civil/military authorities, social or labor unrest, mechanical or construction failures or difficulties, climatic conditions, criminal acts, fire, floods, disease, epidemics, pandemic, labor strikes or any other actions, omissions or conditions outside the agency’s control and disclaims all responsibility or liability for loss, damage or injury. TEDWT will not be held responsible for any damages, injuries or dealth cause by the passenger under the influence of drugs or alcohol and you take full responsiblity for your personal actions while traveling.
PASSPORTS: Everyone, including children and infants, must have a valid passport to travel internationally. Failure to comply will result in denial of boarding, no refund, no exceptions. TEDWT is not responsible for passports in any way. Passports are required to be valid for at least 6 months from your return date. Many countries require that your passport has at least two completely blank pages to be valid and be in perfect condition free from rips, bent pages and water damage.
The rates we provide are for passengers carrying a Canadian passport. Hotels reserve the right to change the rates for passengers booking a Canadian rate but checking in with a non-Canadian passport. Citizens of other countries require a valid passport and may also require additional documents. Such persons should contact consulates of countries to be visited and obtain proper documents before departure. The possession of required and valid passport and visas is the sole responsibility of the passenger(s).
TRAVEL DOCUMENTS: Passenger(s) assumes sole responsibility to independently confirm all documentation requirements for all passport, visa, vaccination, or other entry and/or travel requirements of each destination. Passenger(s) assumes sole responsibility for, and hereby releases TEDWT from any claims or responsibility for any and all damages incurred as a result of Passenger’s failure to comply with applicable documentation requirements, including but not limited the requirement that all Passengers procure, and have on their person the proper travel documents at all times. TEDWT recommends the Passengers consult with the appropriate domestic and foreign governmental agencies for the current document requirements. By agreeing to TEDWT terms & conditions, you are authorizing TEDWT and its agents to accept the passenger contract and all terms associated with your reservation as received by TEDWT.
It is your sole responsibility to secure and/or pay for any and all visas, reciprocity fees, affidavits, immunizations, covid-19 PCR test, etc. that are required to be permitted entry into each destination. In some countries you may be subject to entry (reciprocity) fees and/or departure taxes/ exit fees which will be collected at the airports upon entry/departure by local government authorities. Please note that entry to any country may be refused even if the required information and travel documents are complete or if Passenger(s) have a criminal history. TEDWT is not responsible for you being refused entry in any way.
BOOKING ACCURACY/LEGAL NAMES: Passenger(s) is required to verify the accuracy of each legal passport first, middle & last names and date of birth listed on the invoice and travel documents. It is mandatory that passenger names be identical to the names as they appear on passports, booking and travel documents. Penalties associated with name changes are the sole responsibility of the passenger(s). Passenger(s) is required to immediately review all aspects of their booking to verify (but not limited to): passenger names, mailing address, email address, telephone number, date of birth, pricing, airfare, arrival/departure airports, accommodations, and organized activities on your booking receipt. Please notify TEDWT within 24 hours of deposit if any omissions and/or corrections are needed regarding the booking details. Passenger(s) voluntarily assumes full & sole responsibility for any and all risks and/or costs involved with failure to report such errors and/or omissions within 24 hours of booking.
